BOWLINE POWER PLANT TAX CERTIORARI CASE
West Haverstraw, New York
In 2014, following a four-year dispute between local taxing jurisdictions and Mirant, the owner of the Bowline Power Plant in West Haverstraw, New York, a court ruling reduced the plant taxes by over 90 percent. Court documents show that the plant valuation was determined by taking the replacement cost less depreciation and other adjustments.
The North Rockland School District had to pay a refund of $224.5 million for over taxation in prior years.
INDIAN POINT NUCLEAR POWER PLANT
Buchanan, New York
In January 2017, New York State reached an agreement with Entergy, a Louisiana based energy company, to shutdown and decommission the Indian Point Nuclear Power Plant in Buchanan, New York by 2021. Similar to Long Island power plants, Indian Point contributes tens of millions of dollars in tax revenue to off-set the costs of local government services to local residents. (insert footnote) Entergy has reached agreements with Westchester County, the towns of Buchanan and Cortlandt, the Hendrick Hudson school district, and the city of Peekskill to lower tax revene over four years.
